These Terms of Use ("Terms") govern your use of the SmartNote AI mobile application ("App") developed by Bouhisse.M. By downloading, installing, or using the App, you agree to be bound by these Terms.
Important: If you do not agree to these Terms, do not use the App.
1. Acceptance of Terms
By using SmartNote AI, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy.
2. Description of Service & AI Integration
SmartNote AI provides AI-powered features including audio transcription, AI-based summaries, and chat assistance.
AI Data Sharing & Permission: To provide these services, the App transmits data to third-party AI providers (Deepgram and Groq). This transmission occurs only after you grant explicit permission through the in-app consent prompt.
- Audio Processing: Audio files are transmitted securely to Deepgram for transcription.
- Text Processing: Chat messages are transmitted securely to Groq for analysis and response generation.
Our providers are contractually prohibited from using your data to train their AI models and must provide a level of data protection equivalent to our own.
3. User Eligibility
- You must be at least 13 years old to use the App.
- If under 18, you must have parental consent.
4. Subscription and Payment
- Weekly Subscription: $7.99 per week (auto-renewing)
- Annual Subscription: $69.99 per year (auto-renewing)
Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.
- Payments are processed via your Apple ID account.
- Subscriptions can be managed in your Apple ID settings.
- Refunds must be requested through Apple Support.
5. User Responsibilities
- You are responsible for ensuring you have the legal right to transcribe any content submitted (audio, video, or links).
- You must not use the App for unlawful purposes or to generate harmful content.
- You must comply with YouTube’s Terms of Service when using YouTube links.
6. Privacy and Consent
Your privacy is important. By using the AI features, you acknowledge that:
- Data sharing with AI providers is optional and requires your prior consent.
- You may withdraw your consent at any time via the App settings.
- We ensure that all third-party partners provide data protection standards in line with Apple’s Privacy Guidelines.

7. AI-Generated Content Disclaimer
Disclaimer: The App uses artificial intelligence. AI-generated transcriptions and responses may be inaccurate or misleading. Users should verify all information independently.
8. Limitation of Liability
To the maximum extent permitted by law, Bouhisse.M shall not be liable for any indirect or consequential damages arising from the use of the App or the accuracy of AI-generated content.
9. Apple App Store Terms
- These Terms are between you and Bouhisse.M, not Apple Inc.
- Apple is not responsible for the App, its content, or maintenance.
- Apple has no obligation to provide support services for the App.
10. Changes to Terms
We may update these Terms at any time. Your continued use of the App following any changes constitutes your acceptance of the new Terms.
